Dependent of refugee, applying for ILR

Hi,

A friend of mine was on 5 years visa (refugee rout) which is about to expire. Tow and half years ago he applied for “family reunion” for his brother. His brother was granted a leave to enter which expires at the same time of my friend 5 years refugee leave to remain.

Now that my friend is applying for ILR,

1. can he apply for him and his brother at the same time or same application?

2. If not, what would be the application that my Friend’s brother needs to go for and what would be the visa he will be granted?

Your help is much appreciated.

Grant leave to remain under the Immigration Rules
Successful family reunion applicants will be granted leave in line with the sponsor but they will not be granted status in line as they themselves are not necessarily recognised as refugees. This leave will expire at the same time as the sponsor’s leave expires. If the sponsor has indefinite leave to remain (ILR) and refugee or humanitarian protection status, the successful applicant will be granted ILR in line but not status in line.

I’m guessing that the refugee should be able to include his dependants with his ILR application?

Dear all i would like some clarification on this too.

Husband has refugee status
Wife came on family reunion route (not added as dependent during asylum application because was outside of country).

Does this mean husband can apply for wife ILR same time as his application a month before his 5 BRP time is up, although wife has only completed 4.5 years
