ILR Application In Process - Can I Continue Working?

Post by ElsaDogMom » Fri Dec 17, 2021 1:45 am

Hi IB members,

Seeking guidance with the following:

I am submitting my ILR application (Set M) and per the UK Gov website it could be up to 6 months before I obtain a decision. My current BRP expires on Mar 12, 2022. As my ILR application will be in process am I legally able to continue working with my expired BRP, will Section 3C cover me? Or should I expect to be released from my employment due to the expired BRP?
Alternatively, am I able to apply for a BRP extension while my ILR is in process? Is that even an available otpion?

Thank you in advance!

When you apply before visa expiry, you are subject to Section 3C which extends your lawful residence automatically until a decision is made. Time spent waiting is lawful stay and your right to work does not change. Also, note that you cannot have multiple pending applications
