ILR eligibility 28 day rule

Hi. Can anyone help me please? I am on my 2nd FLR(M). I’m about to apply for ILR. Here’s my timeline.

Fiancé visa and UK entry date: 01 September 2016
1st FLR(M) granted: 17 March 2017
Expiry date: 14 October 2019
2nd FLR(M) granted: 31 October 2019
Expiry date: 27 May 2022

My question is, when can I apply the soonest? Thank you in advance.

The soonest you can apply is 17 February 2022 which is 5years minus 28 days after getting 1st FLRM.
You are qualified to put in your SETM application already.

Thank you for the quick reply! That won’t cause an issue as I haven’t completed the full 60 months yet? And the expiry date which is 27th May 2022 is irrelevant? Many thanks.

There is no such a thing as the 28 days rule. It is simply a concession provided by the home office for all ILR applications where you can get ILR without completing the whole 5 years. UKVI will use the date that is most beneficial to the applicant, so the date of decision is used. For family routes, the date of first FLR(M) or the first entry to the UK will be used to calculate the 5 years. Visa expiry is irrelevant

It will not cause any issue, you can apply already.

ILR Application form

Hello. I came here on a fiancée visa on 01 September 2016. First FLR(M) granted on 17 March 2017. I will be applying for ILR on the 1st week of March which would be within 28 days before 5 years. I have some enquiries about filling in the form. My questions are:

1. What date should I put as my UK arrival date? Is it 01 September 2016?

2. What should I put as my total time living in the UK? From my arrival date or my first FLR(M)?

2. The length you have been living here

Those two questions have no bearing on your ILR
