ILR for Dependent Child (on hold by Home Office)

Hi All,

I am currently on tier2 general visa and my spouse is on my dependent visa. I had applied for my ilr and added my newborn child on the application as well. My spouse was not yet eligible for applying for ilr and hence we did not apply for him.

I have now got an email from home office saying that my child’s application is incorrect as for him to get ilr both parents should have ilr. My ilr application is on hold and I have been given 10 days to respond. They have said i can make a new application for my child and they would consider that but i am not sure what options i can use here

Can i apply for ilr for my spouse as he is now eligible and add my child on that or will i need to apply tier 2 dependent visa for my child?

I would really appreciate your help on this

There is no need for your child to hold ILR. The child has entitlement to register for British citizenship after you get ILR
