ILR for dependent of skilled worker and family visa

Post by MST_11 » Sun Oct 15, 2023 10:32 am

My spouse has been in the UK now for 5 years on two different visas:
1) Dependent visa when I had a skilled worker visa (for 2 years)
2) Family Visa after I obtained ILR status 3 years ago
Now that she has been here in UK for 5 years, can I apply for ILR and under what catergory do I need to apply? I have heard that getting a family visa on spouse ILR resets the 5 year clock on fulfilling the residence criteria. Is that correct?

Yes, in your case ILR clock resets, as she switched from PBS dependent to spouse - two different categories that you can't combine for 5year ILR.

She should've stayed on skilled worker dependent visa; now she needs another 2 years on spouse visa to qualify for ILR.
