ILR Salary Requirements

Post by petromer » Thu Oct 10, 2024 12:11 pm

Dear All,

I have been employed under the Care Visa since 2019, and I am due to apply for my Indefinite Leave to Remain (ILR) in November.

I have consistently been paid the salary stated in my Certificate of Sponsorship (COS). However, during the second year of my five-year route, I received a salary that was below the required threshold.

I would like to inquire whether the Home Office (HO) obtains salary information directly from HMRC or if they primarily rely on the most recent payslip submitted at the time of the ILR application. Furthermore, could the lower salary I received during one year be a potential reason for rejection of my ILR application?

Thank you for your guidance.

Best regards,

For ILR, only your current salary matters. Not being paid enough as per your SOC is a compliance issue for your sponsor but should not affect you as that has been a while ago
