Tier 2 Dependent ILR application with partner now a British Citizen

Post by Anthony86 » Sun May 04, 2025 2:02 pm

I have lived in the country for 5 years, having originally come as a Tier 2 Dependent. My partner was eligible for ILR long before me and has completed both their ILR and received citizenship.

I am now confused as to which route I am then to submit my ILR application. I tried the Set O FORMS and whilst it allows me to select 'British Citizen' for partner's nationality, it later asks what visa they have applied for or been granted (and ILR isn't an option, only tier 2 etc).

I am now confused as to whether I should apply under Set O, Set M, or anything else. Please can someone help?

The fact that your partner is now a British citizen is irrelevant. Also, Tier 2 route no longer exists. You qualify for ILR as dependant under the current skilled worker rules (as per previous status of your partner was under the Tier 2/skilled worker route)

Apply using form SET(O) and choose 'Skilled Worker, Tier 2 or International Sportsperson dependant'

Thank you. I wanted to clarify also what should I select for the below question - Tier 2 general (which is the visa partner had before ILR)?

Which visa is [redacted] applying for or been granted?
Choose the route that [redacted] has applied for or been granted, even if their application is still being processed.

Again, you answer all those type of questions as per your previous partner's status
