10 year path and dependent visa extensions - will this work?

Post by KirkL » Mon May 26, 2025 12:10 pm

Hello,

I am considering the 10 year ILR path (Tier 2 -> Tier 4 -> Skilled worker) in case ILR on 5-year skilled worker path changes (per the proposed white paper).

First visa issued: Sep 14, 2016
First entry into UK: Sep 29, 2016

Current skilled worker visa expiry: Nov 20, 2026
Dependent visa (skilled worker dependent) expiry: August 29, 2026 (I switched jobs a couple of times and never extended hers which in retrospect was pretty dumb of me)

1. Is my ILR eligibility date Sep 1, 2026 (28 days before entry)? I read on a few sites that for 10 year path, it's 28 days before entry not visa issue date.
2. Can I apply before Sep 1 (say August 15 or something) and do my biometrics on Sep 1 (if I can get a date) and Super Priority to get ILR on Sep 1?
3. For dependent visa extension - I'd like to avoid paying for an extension till Nov 2026 (in line with my current visa) and then another 3 year extension. Can I file for a visa extension for her (and future kid) on say August 27, do biometrics a few weeks later in Sep (by which point I'll hopefully have ILR) and just do one (3 year) extension to extend her stay?
4. Anything else I should consider?

1. No. The date of entry is no longer relevant as per Appendix Continuous Residence. You should use the issue date of the first visa

2. Yes. Read: Applicants can benefit from the date of the ILR decision

3. She can extend under the same route but only if you get your ILR. Without you having ILR, she cannot extend. She can apply anytime before her visa expiry.

Also read: ILR clock does NOT reset for skilled worker dependants when the main applicant settles under the long residence

Oh great to hear! So I'll just apply and try to do Biometrics by around Aug 18, get ILR and get her the extension (hoping I can get biometrics in quickly)

Thank you!
