ILR application gap in visa but had work permit approved

A friend of mine wants to apply for ILR under the long residence rule (10 year). He has 2 gaps in his visa: one of 3 days and another of 45 days.

[u]Questions:
[/u]
1. The one of 45 days is a time period he had his passport with his employer who had obtained a work permit but had not sent the passport for visa stamping. The immigration file and stamps show this as a gap. He holds a letter saying work permit is granted for this period. Given this letter, is it likely that this gap might be disregarded?

2. The other gap of 3 days falls within the discretionary period of 10 days - these are likely to be disregarded - true?
