ILR help - self employed so no P60

Post by Ka659 » Mon Apr 19, 2010 12:02 pm

My husband got a 5yr work permit about 4 yrs ago and he is looking to apply for ILR in a year.
When he started working for the company that sponsored him, they decided to employ him as a sub-contractor rather than PAYE. So he has been self employed for the last 4 years, although he has only been working for the company that sponsored him.
His company have transfered him to PAYE so his is now fulfilling the requirements of this work permit but will this period of work carried out for his company as a self employed person affect his ILR application (as he has no P60s)? Do they check back to see if you have been paying PAYE tax for the period of your work permit?
Help!!

Despite being a sub contractor and provided that he has been paying his taxes as required under law, he should have registered with HMRC as a self employed person, completed and submitted tax returns (online or paper versions) which yield year end calculation or certificates. This is admissible evidence as well as bank statements where his salary has been paid into for the last 4 years.

Does he have any of the above or any other records of his earnings?

Hi Plum70

Thanks for your response.
He is registered with HMRC and has all his year end certificates as well as yearly reports from his accountant. My concern is the Home Office will say that because he has been working for the company as a self employed sub-contractor rather than as a PAYE employee, he has broken the terms of his work permit and therefore refuse ILR.
Any ideas?
