Question about ILR

hi All,

Does anyone have any news about new rules of ILR ?

I am in my third year under the old 2 + 3 HSMP scheme ( just got my extension) , I have bought a flat here and I am now going increasingly nervous about the new rules ?

Are there many people in my situation ? can you please throw some light on the new rules if you are aware.

I believe this might have been discussed a zillion times in this forum (probably I might have participated in a few) was just wondering as to what is the impact of the above to someone who is scheduled to get his PR (ILR) in the month of March 2011 ?

Will it have any impact for his citizenship application?

I remember reading somewhere that there is a grace period of 12 months for existing PR holders to get their citizenship in the old route. Not sure if that is still the case

Anyone who is granted ILR or submits ILR application before the new "earned citizenship" laws come into effect will be eligible to apply for naturalisation as per current rules (and not earned citizenship rules) within a transitional period of 2 years (UKBA has taken off the info. from website so can't provide you with a link to confirm the 2 yr. timeline).

This said, HSMP migrants protected by HSMP JR will be protected against the new earned citizenship rules and will be able to apply for ILR (and naturalisation) as per current rules even after earned citizenship rules are introduced.

but I become eligible for ILR only in June 2012 ( by which the earned citizenship will come in action ), does it mean I will fall under those rules or because I had HSMP before and then Tier 1 general for 3 years I will still be considered under old rule ?

I got my first FLR in june 2007 and then did tier 1 extension june 2009

You haven't answered my question.

Anyhow, it is my understanding that you will be affected by earned citizenship rules. Read this post to understand why I believe so.

Apologies I dint give a clear reply, I am under present rules eligible for ILR in June 2012.

And yeah I guess it means i will fall under the new earned citizenship rule
