ILR eligibility

Hi ,

I came to this country in Dec 15th 2006 on WP and currently on Tier 2 ICT.In the last extension (Apr2009) i have got the visa till 04th DEC 2011(11days short to 5yrs completion).

In the above case can i apply for ILR before my visa expiry though i haven't finished the 5yrs?

As per the current rules i can apply for ILR 28 days before the 5yrs completion.Is there any reason HO say i have n't got the visa till 5yrs completion?
