ILR 28 days before and ILR for Dependent

Hi,
There may be a new rules to quick start on 06th Apr 2011 if parliament approves the changes.

Below is my immigration history .

Work Permit (Came to UK on 01 MAY 2006 )
HSMP on 12 JAN 2008 ( Switched from WP)
Tier 1 (General ) on 10 DEC 2009 ( Switched from HSMP) .

I am completing 5 years by 01st May 2011.As per the rule "Please do not send us your application more than 28 days before you become eligible to apply ".

I am planning to apply either 4th Apr 11 or 05th Apr 11 , will that meet the above rule ? This is due to avoid the new rules implementing on 06th Apr 20011 .

ILR of my Wife :

HSMP Dependent Visa ( Came to UK on 24th Jun 2008 )
Tier 1 Dependent Visa on 10 DEC 2009

She is currently with me but she had an absences in UK due to maternity . The below rules says she should stay 2 years in UK with me.

How her time in UK with me is calculated ? Will they consider the absence time in UK due to maternity ( around 9 months ) .

319E. Requirements for indefinite leave to remain

(d) The applicant and the Relevant Points Based System Migrant must have been living together in the UK in marriage or civil partnership, or in a relationship similar to marriage or civil partnership, for a period of at least 2 years.

Could you please advise on the above two queries .
