ILR for Tier 1(dependent)spouse - 2 year rule

Post by cybekpmc » Wed Mar 30, 2011 11:49 am

Hi ,

I entered UK on WP(dec 2005) and then switched to Tier 1 (General) - May 2009 .

My wife also entered with me on WP dependent and then stwiched to Tier 1 dependent.

I and my wife both have complete 5 years in the UK in Dec 2010.

But my wife have gaps of more than 180 days in past 2 years.

1) Can she apply ILR along with me?
2) Are dependents gaps also taken into consideration or is it only for the main applicant?

Senior Members please advise,

Many Thanks
Vivek
