I had my work permit visa (after 4 years) converted to Tier 1 in April 2010. I am planning to apply for ILR now.

I have a query. My visa was converted to Tier1 under Rules before April 6 2010. But the actual visa was stamped on April 13 2010 and the passport shows April 13, 2010. This happened because even though the application was submitted before April 6, 2010 , it was stamped on April 13,2010.

So while applying for ILR, do they use the income requirements as per rules before April6,2010 or after April 6,2010.

I wont meet the income requirements as of the new rules but will do with the old rules.

I have to shortly apply for my ILR

From UKBA site:

Date of application
For applications made from inside the UK this will be taken to be:
where the application form was sent by post, the date of posting; or
where the application form was sent by courier, the date on which it was delivered to the UK Border Agency or the Home Office; or
where the application form was submitted in person at a Public Enquiry Office, the date on which the application and associated payment was accepted.

So in your case, its before April6, 2010.
