ILR for child on 10 year rule

ILR for child on 10 year rule

I was in the UK from 2002 Oct and our 5year old daughter (born outside of UK in 2007) was my dependent on entry to the UK. I and my Husband were on independent HSMP visas originally. My husband got ILR last year (and is eligible for citizenship March 2012). In march 2012, I and my daughter both became my husband’s dependents, and hence, have only Limited Leave as his dependents. Given that we would have to complete the two year rule ‘as his dependents’ per se to get ILR (although I have been in the UK for 10 years and our daughter for 4.5 years), I thought of applying on the 10-year rule this Oct to get ILR.

The question is, how can my daughter get ILR/citizenship given that she is technically not my dependent anymore. Would she have to complete 2 years as my husband’s dependent? Or, would she get ILR independently, after I get mine (with the 10 year rule) as both parents have ILR then? What would be the quickest route for her to get ILR or citizenship. Please help, as it’s very confusing. Many thanks in advance. Any advise is much appreciated.
