I'm a passive reader of this bulletin board. I would like to appreciate all the contributors in this board. I've come on HSMP visa during Sep 2007 (non-JR, Got the Entry clearance during July but arrived late after 2 months) and i got my TierI extension for July 2009 to July 2012.

I would need a clarification in SET (O) form under SECTION 3 - WHICH CATEGORY?


If applying under section A, please note that you will also need to complete the appropriate Tier 1 Points scoring Assessment at section 9.

Section A
1. Tier 1 (General) migrant (excluding applicants applying under the terms of the HSMP Forum Judicial Review Policy Document)
2. Tier 1 (Entrepreneur) migrant
3. Tier 1 (Entrepreneur) migrant accelerated
4. Tier 1 (Investor) migrant
5. Tier 1 (Investor) migrant accelerated

If applying under section B, please note that you are not required to complete section 9.

Section B
1. Tier 1 (General) Migrant applying under the terms of the HSMP Forum Judicial Review Policy Document
2. Work permit holder
3. Employment not requiring a work permit
4. Businessperson
6. Innovator
7. Investor
8. Highly skilled migrant
9. Highly skilled migrant under the terms of HSMP ILR judicial review policy document
10. Self-employed lawyer
11. Writer, composer or artist
12. Tier 2 migrant
13. UK ancestry
14. Ex-HM forces
15. Long residence in the UK (10 years)
16. Long residence in the UK (14 years)
17. Bereaved partner
18. Other purposes or reasons not covered by other application forms

I would like to know in which category i fall under Tier 1 (Section A) or Highly skilled migrant (Section B)?

Also I would like to know about these categories:
1. Highly skilled migrant and
2. Highly skilled Migrant under terms covered by Judicial review.

To my understanding, Highly skilled migrant under terms covered by judicial review are thosee who have got HSMP approval letter before Nov 6 2006.
There are again classified into two categories inside HSMP JR :
a. 4 year ILR for the people who have got HSMP approval letter before April 3rd 2006.
b. 5 year ILR for the people who have got HSMP approval letter after April 3rd 2006 but before Nov 6 2006.

Could you let me know who will fall under the 'Highly skilled migrant' category apart from the above HSMP JR. Does it mean that the people who has come to UK based on HSMP approval letter after 7 Dec 2006 or who?

I believe you are under :

Section A

But still wonder who would be covered under:
8. Highly skilled migrant

Thanks for your swift response Sunil.

Food for thought, the whole of application discusses about HSMP (JR) and Tier 1 applicants. But there is nothing mentioned about HSMP (non -JR) applicants as such. If the HSMP (non-JR) applicants fall under Highly skilled migrant category that would be a cake-walk without filling section 9.

One More clarification, which age should be considered while claiming points is it HSMP (initial entry) or Tier1 (extension)?

I would think it is age at grant of first application (HSMP).
