I would be inclined to suggest that the OP makes an ancestry route SET(O) application on the basis that his spouse, who has RoA, is deemed to be a British citizen according to s2(2) of the Immigration Act 1971.

Unless a decision has already made on his family route ILR application he can vary that application.

Hi Team,

I just want to let you know that I followed your advice, thanks CR001 for your precise direction: FLR (M) route. My visa was approved and I have a 2 1/2 visa after which I can apply for ILR. Whewww.

A Right of Abode holder cannot be subject to grants of (limited or indefinite) leave.

I think UKA 30.1.
The applicant must be the partner or child of a person (P) where one of the following applies:
  • (a) P is, at the same time, being granted settlement on the UK Ancestry route; or
  • (b) P is settled or has become a British citizen, providing P had permission on the UK Ancestry route when they settled.
