Hello friends - All of you have been very helpful .

Please give some time to review the checklist , I have PEO appointment on 16th May along with 2 Dependent's .

Current visa : Tier 1 General , earlier had : Work Permit

I don't wanna leave anything for last day, hence prepared this checklist - let me know if I am still misisng anything so that I can take care and arange the document now.

Here goes the list :

1) Completed SET(O) v 04/12
2) LIUK Test - me and wife
3) 12 months salary slip ( April 2011 to March 2012)
4) 13 months bank statement ( April 2011 to April 2012)
5) Employment Letter - Regarding Salary claimed
6) Employment Letter - Out of UK days ( though days are 167 )
7) 4-P60's and for Year 2011/12 Letter from Finance that P60 not generated for 2011/12 yet.
8. Employment history - Last 5 Years
9) Photos for myself and Dependent's
10) 3 Passports and Biometric
11) HSMP Approval Letter
12) Work Permit

Cohabitation Docs:

1) Wife 's bank statement
2) Council tax bills 2009/10 2010/11 2011/12
3) Rent agreement last 3 Years
4) Wife Salary Slip
5) Wife's HMRC Letters , NHS Letter and other Letter
6) Marriage Certificate
7) Wife's 2 P60's
8. My documents like sal slip , bank statement etc mentioned in above section


Dependent 2 ( Son, born in UK)

1.) Birth certificate - short and detailed

According to my knowledge it would be better that if you apply for yourself and your wife for the ILR and once you get the ILR just after that you can apply for your your son for the british citizenship because he born in the uk . You will need to use the form MN1 for that.

Your checklist is looking fine but as Umesh2211 suggested, you can skip your son’s ILR (as he was born in UK) if you don’t have urgent travel plans.

You can directly apply for Citizenship for your son.

Is it mandatory to apply for citizenship after a year of ILR , can we just be on ILR ........

If on citizenship and we need to travel india on urgent basis - we would require to apply for visa which could take time.

I am not aware of the rules above one is just assumptions.

Please advise the advantage of directly apply for son's citizenship and not ILR now

All looks good - I got last week and was almost similar case . Dont forget to take photocopies .

checklist seems good. as said above exclude your son from the ILR application if you haven't got urgent plans and apply for citizenship using MN1 later

Suppose , we ( me and wife ) takes ILR and then need to travel india in some months along with my 2 yrs old son - will that be OK , he will be on tier 1 general dependent visa and my self and wife on ILR ?

hi aps,

You can remain on ILR status for around 10years [Until biometric card expires]. Afte 1 year of ILR you can anytime get citizenship .
If your 2yr old son was born outside uk then get his ILR done with/immidiate after your ILR before you travel.
If he was born in UK then register him for citizenship and get his passport before you travel anywhere.
If you have to travel without his ILR visa or UK passport then you can not enter back until he gets ILR/Passport when applied from India which might take a lot time in india [may be 6 months]. I am not sure about a cunning workaround someone has done - He has applied his son's visitor's visa while returning and then applied for MN1.

all the above is based on this forum posts - I have no personal experience!!

Suppose myself and wife get ILR on 16th May , THEN what visa status will son hold at that point of time since after I get my ILR son's, Tier 1 dependent visa will get invalid or not ?

MIne visa will be ILR so how come he hold tier 1 dependent visa that time

This seems confusing ......

If he is UK born then it should be fine for him to be without any VISA because it is his right to stay. I have many example where Parent GOT ILR leaving kids on NO-VISA. I am doing same next month.
For non-UK born, get the VISA same time with you.

Please go thru below and advise.

Here are the steps I assume will follow , these are just assumptions please help let me know which steps need to be re-shuffling and also add other relevant steps .

1.) I plan to apply ILR for myself and wife only and as soon as gets ILR , in next some days via MN1 form section 1(3) will apply for British Citizenship for my son.

2.) If all goes well son will get BC then apply for British Passport

3.) IF Son gets British Passport then at that stage he will hold 2 passports.

4.) Surrender Indian Passport and than apply for son's PIO card via which he will be able to travel India with us without any restrictions.


If all points gets well then the outcome wil be :

1.) Myself and wife : ILR status
2.) Son wil be British citizenship with british passport and PIO card to travel india without any restrictions

I am in same shoe and doing step 1 next week ...

you have not confirmed but I am assuming that your son is UK born and less than 10 years old.

As soon as you get your ILR, all of your dependants needs to change thier visa category, as they are no more dependant of a Tier 1 General Migrant. Since your wife is also getting ILR with you so you only need to apply for your UK born child registeration as soon as you get your ILR. The prescribed form for this purpose is form MN1.
