Stay on Tier 1 Dependant or switch to FLR required?!

P.N - I am aware of the sticky "FLR or ILR for my Dependant" but it was a tad confusing for me :(

Query -

I am eligble for applying ILR this october 2012

Work permit - Oct 2007 to June 2009
Tier 1 General - June 2009 to June 2014

Total time claimed - ( 1 year 8 months on Work permit + 3 years 4 months on Tier 1 General)

My case is pretty straightforward and should be able to apply for ILR around September this year.

My query is pertienent to my wife, We got married in September 2011 and she currently cant apply for ILR alongwith me.

Her current dependant visa based on my Tier 1 General visa is till June 2014.

The question I have is would she require to change her dependant visa to FLR as a dependant again after my application for ILR has been successfull or would she just be able to continue on her tier 1 general dependant visa which she currently posseses

I am guessing that she would have to switch to FLR once i get my ILR but just need to clarify my understanding before I go and waste my application fees...any help on this is greatly appreciated

Once you get your ILR, you will no longer be holding a Tier-1 visa and she can’t be dependant of your Tier-1.

Your assumption is correct, she needs to switch to FLR(M) once you get your own ILR. And when she completes 2 years in UK, she can apply for her own ILR.
