ILR & Bank Statement Issue

Hi there

I have booked an appointment for ILR at Solihull PEO on the 18th June. I always get paid on the 15th of every month and my bank statements are generated every 28th of the month.

Now the UKBA requirements are

Personal bank or building society statement: This must be the most recent statement dated no earlier than one calendar month before the date of the application. The statement must clearly show your: name;
account number; the date of the statement; the financial institution’s name and logo; and transactions by the sponsor covering the period no earlier than one calendar month before the date of the application.

We can also accept as evidence:
A bank or building society statement printed on the bank’s or building society’s letterhead, but this excludes mini-statements from automatic teller machines (ATMs); An electronic bank or building society statement from an online account, but it must contain all of the details listed above. You must also provide either: a supporting letter from their bank or building society, on company headed paper, confirming the statement
provided is authentic, or an electronic bank or building society statement bearing the official stamp of the bank or building society on every page.


I was thinking to go in the branch on the 15th June and ask for printouts on the Bank letter head (HSBC Bank) but reading on this forum, it seems like HSBC have stop issuing letter headed statements.

I will have my June salary slip with me as my company posts them to us well before in advance but for the bank statement could this be an issue as my previous statement where they could see my salary come in will be 1 month and 4 days old.

I too think it's really difficult to get the most recent statement on letterhead for PEO appointments as you cannot change the bank's statement generation cylce. I will wait for others to comment on your actual query on how they were able to workaround it.

On a related note, this statement is contradictory with other guidelines that state that you are allowed to use any 12 months pay period from the last 15 months...

Thanks Srikp, I should have mentioned I will be applying under Tier 2(Gen) - Set (o) Application.

Hi

To the best of my knowledge you should be fine with your bank statements, all I can say to you is that just be confident people who work at UKBA are also human beings like us luky we. So just explain the same thing to them as well what you've just explained in the post on this forum and I think you should be completely fine. It would have been a problem if you were taking a 3 months old bank statement which is not justificable by any sense.

Please do kindly share your PEO experience on the forum.

There are two aspects in the ILR application where bank statements are relevant. Note however that the requirements that apply vary depending on the route you are applying under. The following will be applicable if you are applying as a Tier 1 General Migrant.

1) Evidence for Previous Earnings in the Points Based Assessment - Here the UKBA state that you can claim points for 12 consecutive months of earnings in the 15 month period prior to your application. For this you would need the bank statements for the specific 12 months you are claiming points for.

2) Ability to support yourself & any dependents in your application. - There has been some confusion of what is expected here, and if you search this forum you will find several threads where this question has been raised & answered. The SET(O) form states that you should provide evidence of your finances to prove your ability to maintain and accommodate yourself and any dependants without recourse to public funds. Based on other forum experiences I'd say you don't need your last statement to be within the last calendar month for this. To me, the evidence you provide for previous earnings will satisfy this requirement, as this will clearly indicate that you are earning and therefore can support yourself & any dependents.

From what you are saying, your may pay should appear on your latest statement which will be generated at the end of may/begining of june. This statement should be enough as it wont be older than one month when applying on the 18th. I dont think the caseworker would ask for junes statement/pay so you should be fine if you provide three month statements up to and including mays pay
