Sponsor working outside the UK, spouse's ILR?

Hi to all,

I need some advice with respect to ILR.

My wife came to the UK in Feb 12 on Spouse Visa. I am presently working in the UK although I have a possible job offer overseas. The job offer overseas is financially attractive hence my dilemma.

Can I live and work abroad as an ‘expat’ leaving my wife back in the UK, both her and I would take turns visiting occasionally, but her more than me. I would ensure that she isn’t outside the UK for a continuous 90 day period.

Can I still secure my wife’s ILR status in two years time?

I would be grateful for your thoughts and would like to hear from those who have been in a similar position. Depending on the outcome I would either choose to accept the job or not.

Many thanks.

Your wife won't be able to apply for ILR if you aren't both resident in the UK.

Casa - thanks for your reply.

I had a suspicion that would be the case. Although in a way, it is somewhat disappointing and career limiting. I assume that once the ILR is granted and naturalisation occurs, from that point onwards there are no rules stopping me or us to leave?

Would that be true and if so, would that be a more favourable time to leave for any possible oppurtunities?

Thanks again.

Yes and yes.
