ILR -need advise - spent 177 days out of uk in one go

Hi,

I am posting this for my friend.

He is having Tier 1 and due for ILR July-2012. In mid 2010, he went to India for 177 days. In total 250 days in 5 years he is out of uk.

throught this period( 177days out of uk), he received salary for four months. he is with different company now and difficult to receive any letter from previous employment for covering that period.

so now three question arise because of this situation
1. should he go for ILR this July-2012 with strong medical reason for period he was out of uk?
2. should he apply for extension and apply for ILR after 6 months means around dec-2012 ?
3. should he apply for extension and wait to complete 5 years starting from end of 2010 before he can apply for ILR ?

What was the reason(s) of the absence?
What evidences can he provide to support his claim that he could not return to UK any earlier?
For the 4 months that he was paid salary, was he paid in the UK?
Did he return to UK and resumed the same employment?

- mostly personal & family reasons
What evidences can he provide to support his claim that he could not return to UK any earlier?
- medical certificate(s)
For the 4 months that he was paid salary, was he paid in the UK?
-- Yes
Did he return to UK and resumed the same employment?
-- no, he joined different employer.
