90 day rule need help please!!!

Hi,
I am staying on dependant visa (issued Oct'10) with my husband who is on Tier 1 general and he will be eligible for ILR in Sep'13. I am currently in india for personal reasons. My question is does the 90 day rule apply to me when i apply for ILR with my husband. Because we both want to apply for ILR at the same time. It is nearly 2 months I am out of Uk and planning to return next month, where i will be out of UK for 92 days. I tried to search guidance forms, but I could not find any mention about length of stay for dependants.
Senior Pls advice.
