Visa expires before 5 years

Hi
I have 2 questions:

1. I have an ancestral visa that was valid from 04/02/2008 and ends 04/02/2013. I however entered the UK for the first time on 27/03/2008.
    According to their website, they say the following:
 
    "been present in the UK five years before the date of your application"
 
   If I apply for the Indefinite Leave to Remain after 5 years present in the UK, my ancestral visa would have expired.
   My question is now: Do I apply before my visa expires, but before I have been in the UK for 5 years.
 
2.  My partner came over 22/09/2010 on a Unmarried Partner visa, and according to the visa, it also expires the same day mine expires, which is      the 04/02/2013.
 
My question regarding her is: What does she need to apply for, for her to stay with me in the UK after 04/02/2013.

The period between the date of the visa emission and the date of your entry can be included into the residence period. You can both apply in one joint application no earlier than 28 days before February 4, 2013.

So can we just have in one pack of documents for us both once.
Also, does that mean that my partner can apply for ILR?
