When to apply for ILR?

Hi. I appreciate if anyone could help me please. I arrived in UK 24 April 2006 with visa student nurse. 31 May 2007, I was issued another visa limited leave to remain as my employer was still applying for my work permit. 24 August 2007, my work permit was issued and I got another limited leave to remain visa 5 September 2007 until 5 September 2011. I was given another permit Tier 2 General Leave to remain last 9 November 2011. My query is: when can I apply for indefinite leave to remain? 'hoping for anybody to give me information. Many thanks.

Assuming you made a valid leave to remain application as Tier 2 (General) migrant before 05-Sep-11, then:

No earlier than 28 days before 05-Sep-12.

Yes, I made the application before 5-Sept-2011. There was only a delayed reply from the home office as I made my application through post. Thanks for your reply. It's just that I have to clarify because Unison Immigration Lawyer advised to apply 28 days before 24-aug-12 for that's the time work permit was issued.

Date of issue of WP has no relevance in this case

Hi

In simple terms you can apply 28 days before the EC date if you arrive in the UK with in 90 days time period from the issue of your WP Vigenette or if you're residing in the UK already at the time of issue of your WP then you need to take the date of issue of your WP vigenette on your PP calculate 5 years from that date and then just apply 28 days before the date of issue of your WP vigenette on your PP once the 5 years residence period will be completed.
