ILR Changes and SET(M) application after 9 July

Hi everyone,
I've read a lot in the forum but still can't assess my situation. Could you please help me?
- I got my biometric residence permit in August 2010. It is valid for two years and it expires in August 2012. (I am the husband of a British citizen)
- My plan was to apply for ILR by August 2012, as according to the old rules I was eligible.
- Therefore I HAVE TO apply for ILR after 9 July, when the new rules come into effect.
- Does this mean my situation will be assessed according to the new rules? Or because my overall process started earlier I go with the older rules?
Does anybody have any idea???
