ILR - (HSMP~Tier1) - 5 Year Economic Activity

Hi all,

I am a newbie, planning to apply for ILR in July end. First of all, a massive thanks to all you guys doing a great job here.

My case is straight forward - HSMP (Aug 2007) - Tier 1 (2009). I wanted to know what are the guidelines that the case worker will follow for economic activity for past 5 years.

Soon after I got HSMP, I quit my then job and took couple of months off to do some courses. Started looking for jobs soon after, however only got a job in January 2008. So for the tax year ending 5 April 2008, I only have the total pay of approx £11000. There is a gap between 20th Aug 2007 to 21st Jan 2008 (5 months) which I was not earning or paying tax.

I have been in full time employment without gap and have healthy income for every tax year since then. I am eligible for 45 points for my earnings this time when I submit my application.

Will this 5 month gap cause any issues with my application? Someone informed me that the case worker will check the entire 5 years economic activity and may reject the application if they see a gap.

Any advise in this matter would be much appreciated.

No it won't. There are many people who are out of work for periods of time during there residency, but go on to get ILR without a problem. The information your were given (i.e. the statement above) is incorrect.
