ILO- PEO appointment - 28 days before 5years period

Hello everyone,
My current leave to remain expires on 19th August 2012. My visa history as below;
WP - (13Sep 2007 - 31st Augst 2007)
Tier 1 (19th Aug 2009 - 19 August 2012)

I want to get a PEO appointment for ILR.

Couple of questions regarding taking appointment before
28 days of qualifying period.

Do I need to count the 28 days from the expiry date of my visa(19 Aug 2012)?
Do I need to count the 28 days from the 5 years stay in UK (13 Sep 2012)

Any suitable dates u guys suggest??

I came to UK on student visa. I joined my previous job on 16 th July 2007. My employer applied for WP and received it on 13th Sep 2007.

You need 5 years from the date you arrived in UK. You can apply 28 days before this 5 years are up.

Assuming that 13-Sep-2007 is the date of issue of leave to remain as a WP migrant, then you may apply for settlement no earlier than 28 days before 13-Sep-2012.
