ILR dependant in 1980 - Do I need to reapply as an adult?

Hi there,

I have searching everywhere for an answer to my problem, but haven't been able to find a simple answer, hence my post. I hope that someone may be able to shed some light.

I am Australian. My birth certificate is Australian and I have been issued an Australian passport. I was born in Sydney in the 70's but was brought to this country when i was 18months old. My mother and I were given ILR by the HO in 1980 and I appeared on my mothers passport with the ILR confirmation. I have the HO ref number, but also believe I should be issued with my own HO number, perhaps as an adult?

I since obtained a passport, completely clueless as to the immigration problems that would occur [I hadn't seen my mother in decades] I travelled to Greece in 2006 only to be told on my return to the UK that I was here illegally [no visa or ILR stamp] and given 2 months to remain.

My question is, am I still eligible for the ILR and am I able to transfer this over to my present passport or do I obtain a new one with a ILR stamp from the HO. If so how would I go about doing this?
I am just about to lodge an application for ILR which is very costly and would hope to avoid this if at all possible, but I am also aware of the time constraints regarding the 9th july changes.

In short, is my previous status of ILR still valid?

Do you still have your mother's passport that confirms your ILR?

Hi, thanks for replying. Yes, she has it. She sent me a picture last night to confirm.

If you had ILR and were away from the UK for less than 2 years, then you should have been treated as a returning resident.

However, what happened since you entered in 2006?
