ILR query

Hi,

I work as a contractor and had my VISA till AUG 2012 and I am eligible to apply for PR in July.
But to get one specific long term contract they asked me to apply for extension and considering that it was financial beneficial to have that contract, I applied for extension. Now I have VISA till AUG 2015, but to save cost I only applied for my extension and my dependants still have VISA till AUG 2012.

Now when I am trying to apply for PR with my family in July, one person told me that as now your wife is in your old VISA and you got extension, her VISA has already invalid now.

Can you please advice me on following points:

1. Can my dependants apply for PR with me.
2. Are they still legal as their VISA is still valid till Aug 2012. Or I need to apply for their extension within 28 days from my decision.
3. I have gone through UKBA site but was not able to find any case that matches my scenario.

Please advice what is the best way to proceed, called UKBA number got contradictory reply, is there some thing in the website that I can refer to.

1. Yes, if they qualify for settlement.

Thanks a lot for your promt reply, Your help is much appreciated.

Till now we have got two contradictory reply from UKBA number. I can just pray and hope to get positive result on the day when I apply.

I have gone to the UKBA site and found this clause
(c) The applicant must have, or have last been granted, leave as the Partner of the Relevant Points Based System Migrant who is being granted indefinite leave to remain.

I think we come under this as my wife was last granted Leave to remain with me.
