Wife Currently On Tier 2 But Will Be Switching To Tier 1 Dep

Hi All,

Hope this message finds you all well. I see UKBA has been making laws tough and tougher every day

My situation is a very complicated one -

I have been here in UK since 2006 - came as a student, switched to PBS 1 year later, and got my Tier 1 visa in Jan 2010.

My wife came here as a student in August 2008, got her PSW in Jan 2010 and is currently working on a Tier 2 Visa Nov 2012.

We have been living together in UK since August 2008, have all the proof - with bank statements, bills, are on the electoral register, etc. Gladly she is expecting our 1st baby now and will be heading for home in Dec for 4 - 5 months and planned to switch to my dependent on Tier 1 Visa.

Now surely with all the evidences this is not a sham marriage and she has been living with me for the past 4 year now - although not in a dependent status.

Now when she gets back from home on my Tier-1 dependent visa - will she need to wait again for the next 5 years to get an ILR, or we can show that after 2 more years we will have been together for 6 years here in UK?

I think Home office is being really unfair in putting such a lame rule out there
