Sorry this must be a reptitive question - I couldnt find the answer

If you apply for ILR, 28 days before expiration of a spouse Visa but receive no response until 2-3months later, does this count as an overstay?

considering the spouse visa expires 28days from the date of the ILR application. Hope this makes sense..
