HSMP - Tier1 >> Spouse ILR

Hi all
Thanks for this great forum, I got my ILR few days back. A great help from this forum.
My question is : my wife wasnt in this country when I applied for ILR, now she is back, She already spend more than 3 years in UK as a PBS dependent. Now my question which form should i use for her visa, SET M or FLR M. Will she get an ILR or further leave.
I think it should be SET M as she came to UK as dependent in March 2009. But lawyer made me confuse he says it should be FLR M and then complete 5 years. I dont want to waste money by sending a wrong form to UKBA.
