My Application is on hold...Please help me soon :(

I had PEO appointment on 13 Aug 2010.
In my 12 months of earning I am show 4 month I was contracting through Limited company.
And I have transferred 3500/- each month to my personal account.
And the payslip which my accountant have created have PAYE detection of 1.40 every month but NI is 0.

Now in the interview they have put my application in hold asking to submit a document with 14days.
And PEO mentioned if you submit the decision will be positive.

This is how it is mentioned in the letter provided.

Documents required:
"National Insurance contributions documents to HMRC for your company xxxxxName Limited"

If you fail to provide the required documents, the application will be considered on the basis of the documents that you have already provided. This may result in your application being refused in accordance with paragraph 322(9) of the Immigration Rules.

Questions:
1) DO I need to get confirmation from the HMRC as NI Paid (IN that case my payslip dont have NI is 0 and I have not paid. Then how can I show that)
2) If not what else is he asking
3) Do I need to take lawyers help?
4) Did anyone face this issue before?

I can not understand that why NI contribution on youur payslip is zero. If you are director of the ltd company then on your ist payslip the NI s Zero i my view but after that there should be NI contribution on your payslips

the ist 2 month of the director payslip the NI contribution is zero As your income id under the treshold. But when you cross the thresh hold your payslips must show the NI contribution. Senior please comment

strange. if you taking £3500 salary every months you should pay NI and TAX and shown on the payslips.

its really strange.

do u take salary or dividend ? from your company ?

Mention about the salary you drew , Dividend you drew and also did the CW said that NI is madatory or for the salary you tool NI is to be paid ?

HI Guys,
Sorry for late reply.
I have been posting under different topic and didn't notice the reply here.

SO as I have claimed 11 months salary in which 3 months is the only payment done though my Limited company. (Employed as director 100% share holder)

In this case I was drawing salary 683.33 and dividend 2816.67 total 3500/- for April, May and June

As "adnanub" mentioned I don't have to pay NI before limited company my salary exceeds 7605/- that is why NI is 0.
I got to know this when I check with Accountant.
And it seems as per "national insurance for Directors CA44" it can be paid as a annual one.

Guys Last Friday I have submitted few supporting documents from my
1) Accountant letter
2) Solicitor letter explaining the law in place.
3) Cover letter explaining the member details of HMRC to whom I spoke with.
4) Few Pages of CA44 which HMRC booklet describes about the Directors NI

But I could not produce the document from HMRC as requested with the given date. As HMRC is slow in process and it will take more than 14 day which is given by UKBA.

What do you think guys?
Also do you have any idea how long it could take?

it means from now guys plz pay little NI as well it will ease your application .

Not paying NI make them suspicious. If CW have deal 10 case a day all with NI paid and 11th case comes up with no NI paid he will be suspicious etc like we are playing trick taking high dividends and less salary.

I'm in the same league as not paying any NI on my salary through limited company. I contacted my accountant who mentioned that they can show NI contributions only after the salary reaches around £7500.

I've to increase my salary a lot to achieve this as my ext is due in Jan. I paid some NI in Feb-March this year. How can I avoid the same situation?

has anybody got the extension with minimum salary (showing 0 NI)?

Also useful (though I am unfamiliar with this territory) is page 43 para 11M on SET O form itself. There is quite a bit of guidance on NI as it relates to T1.

Good News :) ....I got the love letter from UKBA. My Visa is approved.
So that mean if you are a contractor you need to pay some sort of NI if you salary is more than threshold limit.

If it is under threshold limit then produce document from HMRC or Registered accountant stating the same.

Problem solved!
