What is the earliest date I can go for ILR ?

Hi,

Can any one please advise me the earliest date i can go for ILR ?

The below are the time lines of my Visa.

1. HSMP Entry Clearance was granted on 16-Jan-2008
2. Entered in to UK on 20-April-2008 (94 days after the visa issued)

Currently I am on tier 1 Visa which is going to expire in 2013 Jan and applied for another extension and waiting for the result.

Am I eligible to apply for ILR After 20-Jan-2013 as i will be finishing five years visa and also stayed extra 4 days (94-90) which was short for entering the UK within 90 days rule ?

or

Do i need to apply for ILR 28 days before completing the 5 years residence period. ie on or after 23-March-2013?

As wpilr_nov12 also advised, since you delayed your first entry for more than 90 days (95 Days), you cannot benefit from the Modernised Guidance for Calculating Continuous Period in the UK.

However you need to apply 28 days before the 5th anniversary of your first entry to the UK which is on or after Saturday, March 23, 2013. (as 23rd & 24th March fall on a weekend, the earliest you can apply is 25th March 2013).

Thanks for your help.

One more query :

My daughter is in India (born in inda) and we are planning to bring her to UK after we got the PR.

Right now she has Tier1 dependent visa valid up to Jan 2013 and she came to UK once , and it is going to invalid once i got my extension (I am not sure).

My query is , will it be ok to apply for her once i got the ILR ? and what will be her visa status ?
