ILR Application after 4 years and 11months ?????

Hi Folks,

I need some advice on an application.

I was granted HSMP entry clearance on the 26th of October 2007 (2 year visa to run from 26th October 2007- 26th October 2009), however I entered the UK on the 20th of November 2007 ( 3 weeks + later)

My HSMP expired on the 26th of November 2009 and just before the expiry I switched to a Tier 2 visa status (this was granted for 3years) this visa expires on the 23 Oct 2012

By the 20th of November I would have spent 4 years and 11 months (on the combination of the HSMP & TIER 2 VISA)

Do you advise that I make an application on the 20th of October 2012 for an ILR just before its expiry? my worry is that it states on the UKBA that to be eligible to apply one must have spent 5year as a combination or either HSMP & TIER2, and by the 20th I would only have spent 4years and 11 months.

Or would you advise that I try to extend my Tier2 visa to allow me reach the much needed 5 year criteria?

I really appreciate any advice

Based on the info you have given here, you can apply during the 28 days preceeding the 5th anniversary of your EC. This is applying the 3 month concession, which could be applied in your case.
