Hi there, As stated on my sub here is my history.
HSMP Letter Jan 2008
HSMP Visa July 2008
Arri in UK Aug 2008
Exten before 19th July 2010
Refused - appeal - given Tier1 Gen under PBS

Now I am due to for ILR and have some questions and would appreciate if you could answer them.

1- Now what are my points be calculated on... old one or new one - example - old one earning 40000 and above = 45 points... on the new table the same earning is showing as 30 points? My earning has increased to over £50000 but still I am not getting required 45 points. Am I eligible for the previous or new one?

2- During extension the High court rules that there will be no maintenance funds requirement but on the new rules it is shown as £900 needs to be in the account as maintenance funds...is this correct? Are they also required for any dependents and how much?

3- Do I need to appear for the Life in Britain test to get 10 points for the language?

I am due for ILR next year but the above questions are making my head spin so please help me understand.

1. The only date that is of any relevance here is the date of application, i.e. - the date on which you applied for either HSMP approval the very first time (leading to a successful grant of leave with / without an appeal or administrative review). Accordingly, ascertain which table is relevant for you.

2. Read FAQs for ILR - WP/Tier 2/HSMP/Tier 1 - Read before posting

3. LITUK is a mandatory requirement for all PBS migrants applying for settlement. Unrelated to the "10 points for English language requirement".
