ILR for dependants

Hi All,

Just wanted to clarify a scenario for Tier 1 dependant ILR.

If dependants are given second extension after 9th July 2012 and extension is applied separately from main applicant as main applicant has gone through his/ her second extension either post/ PEO. What rules will be applied, Is it before or 9th July 2012?

This question arised because I believe dependants are technically dependant if Tier 2 main applicant applied his extension alone. Although I could not find any guidance for same.

Could I rephrase the question.

I am applying for my Tier 1 second extension Visa in October 2012 and my dependents will apply in Feb 2013. I wanted to make sure that this doesn't result in rules changes when we apply for ILR in 2014 (i.e they will still be evaluated rule before 9th July). Almost same thing happened to one of applicant, He didn't applied for dependants extension same time as his. AT PEO for ILR, he was advised that, because he didn't applied for dependent extension at same time, he didn't technically have any dependent. My concern is that if they do not consider them dependant anymore they may evaluate them under new rules(after 9th July).

Hope this make sense, Would appreciate any reply.
