ILR Eligibility Date confusion!

Hi,
1. I just need to know that when I am eligible for ILR as my Visa will expire on 30th of December this year and I entered UK as a Fiance and got FLR(M) on 30 DEC 2010 as a spouse of British citizen.
2. If I book appointment for 3rd Dec. then will it fall within the 28 days eligibility period as visa will expire on 30th of December?
Any Help in this regard will be Highly appreciated.
