10 years Longstay SET (O) Biometric and Tier 1 Expiry

Hi All,

I have been following this forum since many years, I find almost all anwers I need.

Now I am applyig for 10 years long stay ILR next month, mid of Nov 2012 (28days before I qualify for ILR, actually it will be 10years by Dec 14th 2012).

When I was applying for Tier-1 General I went through Biomentric and all, do I need to go for Biometrics again?

My Tier 1 General is expiring May 2013. After going through the forum I understand that UKBA is taking up to 6 months to make decession. So, what happens if my Tier 1 G expires before they take any decission? Do I have to withdraw ILR application and apply for extension?

Any help would be much appreciated.

1. See Bioemtric enrolment and BRP - General Queries.
2. If you make a valid, in time application for settlement then your PBS leave will remain valid even after the date of its expiry under section 3c.

Hi SushdMehta,

Thanks for your reply and I forgot to ask you few questions, there are two dependents, one year old baby and my wife who is working. Lets say if my ILR application is still under consideration and my Tier 1 is expired, Can I and my wife still continue our employment?

Your settlement application has nothing to do with your wife's right to work in the UK. She derives that right on the basis of leave issued to her.
