ILR application - 88 days delayed entry

My details as follows:
Initial visa grant : 15 November 2007
First Entry : 12 February 2008 (88days after visa grant)
Extension in October 2009 to 15 November 2012
I have a PEO ilr appointment for 14 November 2012
My question is......
Can I apply for ILR using PEO between now and 14 of November 2012?
I am confused as people keep saying you should not use PEO before the 5th anniversary of your initial grant( my understanding is that you can only use postal service any time from 28days before your grant expires) )

Do you have another appointment booked between "now and 13-Nov"?If so, then yes you may.

Hi Sushdmehta,
Thanks for your prompt response.
I have not been able to secure another appointmnt before 14 November. I am going to keep trying to see if i can get an earlier date.
Just to confirm, is there a problem with 14 November?

First of all I will like to say a BIG THANK YOU TO GOD ALMIGHTY....
--- To gabi4 and Jd.... thanks, your posts made all the difference. I was almost thinking of extension or applying using postal service till i saw your posts where you indicated that you applied 28 days before fifth anniversary using PEO.
---- To Sushdmehta, thank you very much for your prompt response and clarification on the issue. I got appointment for the 9th ( 5days before my fifth anniversary) and my application was successful at Birmingham PEO
--- To all the staff at Birmingham PEO i say a warm thank you, you guys are the best.
My appointment was for 11:30am ;
- At 11:35am i was already done with payment and was waiting for my biometrics
- Finished biometrics at 12pm
- collected my Approval letter and documents at 1:30pm
Documents submitted:
Passport
2 Passport photos
Set O application form
12 Months Bank Statement
12 Months payslips
LIUK pass notification letter
UKBA Self Assessment Summary
Absence Spreadsheet
(I had other documents with me but they didn't ask for them)

Hello omo,
Congratulations.
My case is very similar to yours and I am also planning to apply for ILR directly instead of an extension.
My entry was delayed by 88 days(within 90 day clause) and apart from initial delay so far my holidays have been 120 days(within 180 day clause).
How many absences(out of country) in your case?
@All: Can I make use of remaining 60 days(may be just 50 for benifit of doubt) as holidays? Please advice

Hi guys,
Can someone please point me to this point based self-assessment calculator people keep talking about?
The one I found on the site was only for Tier-1 application etc, not for settling in the UK.

There is only one PBS calculator, if you are applying for ILR as a Tier 1 migrant, then thats what you should select when you are asked "Select the Tier for which you are applying". See Q36 - Where can I find the PBS calculator for ILR?
