Hi All,

I have a total absence of 182 days:

126 days - Holidays(most of it are paid leaves)
53 days - delayed entry in to UK(got HSMP 28 Feb 2008, entered UK 23 APR 2008)
3 days - Business trip.

Am i eligible to apply for same day ILR?

Thanks in advance

Question 17a of FAQs for ILR - WP/Tier 2/HSMP/Tier 1 suggests that initial absence is not counted towards the total absence.

Can someone in the same situation/experts answer please?

Is there a possibility of refusal for my application?

1. You don't need to account for the delayed initial entry in your total absences.

2. there will always be a possibility of rejection of any application. But wrt your absences, if your did not have any single absences of 90 days continuous or 180 days total, you should be fine.

You are right about the rejections. I do not have 90 days continous or more than 180 days(excluding initial days) of absence. Thanks. Your word are encouraging :)
