ILR - Away from UK for 10 months for Business

Hi All,

Don't know if anyone come across this situation before.

I'm on Tier1(General) visa working in UK for last 5 years (from Feb 2008 to Feb 2013). In mid of Year-2010, As contractor working through own UK LTD company, I had signed contract with Italian company and had to go and work in ITALY and worked there for 10 months. I was getting my invoiced amount to UK Business account but i was physical based in ITALY for 10 months. Due to client restrictions, I was not allowed to work remotely. Therefore, had to based in ITALY only. I hardly came to UK for 3 or 4 times in these 10 months.

All in all, I was away for 10 months from UK due to business purpose as explained above. Does this will be barrier in applying for ILR as ILR has condition of 5 years continuous stay in UK ?

Had anyone faced the similar circumstance and got the ILR before ?

Can anyone help me what would be best way to go for ILR in above situation. I'm out of country due to Business purposes only. Is there any documentation/guidance notes explains the eligibility for ILR considering out of Uk work due to business purpose for 10 months etc.

Please can expert advice on this ?

u said you travelled to the UK 3/4 times. In these 10 months was there any period that you were in italy for more than 90 days at a stretch?

I have been coming back to UK once in 3 months but yeah there was period when I was unable to come back to UK in 3 months time (from October - January) during these 10 months Business work in ITALY.

can any expert please suggest on being away from UK for more than 10 month for business purpose ?

While physically based in ITALY for 10 months for business work, I travelled to UK 3/4 times however, there have been period where I was unable to come back to UK in 90 days.

Please any expert suggest how to apply for ILR in these circumstances ?

I myself have had 6 months of absence from the uk and on one occasion it exceeded 150 days. Total absence in 5 years is 258 days. Obviously it is at the discretion of the case worker as I have violated both conditions. However, I have alL proofs of being paid in the uk and letters from company mentioning that the nature of the trip was necessary and cldnt be avoided and I was the only person who could do it etc.

Hence I am confident it will go thru hence it shld be the same with you.

Is there any format or spreadsheet you used to address the UK Absences as absences are quite long and tricky although they are business related.

COuld you share the format that you used for UK absences related to business trip.
