I came to the UK in 2001 as a student and overstayed my visa. for 11 years i have being in this country. within these years i met my wife and we both got married. She is also from my country and has also overstayed her visa. we have two sons aged 8 and 4.

Recently i made an application for indefinite leave to remain under the old system on Art 8. My application was refused. I need to make an appeal within ten days. On the surface i don't have a strong case and it seems my only salvation will be my child who is 8 and was born in this country. I need help. anybody out there that can help me with advise and opinions will be much appreciated.

Thanks

Under old rules, one could apply for discretionary leave to remain under articles 8 if one was an overstayer, but not indefinite leave to remain as an overstayer.
