ILR applicable with new rules from 13/12 and stay > 90 da

Hi,
I am in UK since 2007 Jan and was working for an indian IT company. However, i had to travel to India after 2 years and had to stay for >90 days(4 months in mycase). I am now applying for Tier-1 extension second time as i know that UKBA has become very strict.
Am i eligible for ILR now considering the new rules from 13/Dec ?
I guess there are lot of candidates with this query has most indian IT companies do send their employees back(called as cooling period) after 2 years to avoid taxes
Any thoughts or help would be appreciated
