ILR Refused and sill can I apply for Tier 1 gen. extension?

Hi,
My IRL is refused and the current tier 1 general
visa is expired by the time decision is made. However, I never extended my Tier 1 general visa because I was under work permit before Tier 1 visa and by combining them I made 5 years to be eligible to apply for ILR.
Now, I have given the opportunity to appeal against ILR refusal decision (reason: non-continuous stay in the UK) within 08 jan 2013.
While appealing the case, will i be able to request to apply for Tier 1 general extension (may be using 3C) because I applied for ILR well before my visa expiry and I think that is not fault for getting decision late?
