Hello Guru's,
I had posted this query earlier, but was waiting for the new ruling of 13 dec. Can experts please advice me on my case?
Following is my status. Tier 1 general
HSMP Visa granted on September 2007
Entered UK November 2007 (2 months after visa being granted)
Went on a holiday (PAid leave) in May 2008 (10 days)
Went on holiday (PAid leave) in Oct 2008 (17 days)
Went on holiday on July 2009 (17 Days)
Went on hoiday on Jan 2010 (16 Days)
Went on holiday on May 2010 (9 days)
Went on holiday on Oct 2010 (9 days)
Went on holiday on April 2011 (16 days)
Went on company work on August 2010 (44 days) (For company work to train offshort people, have compnays letter) Paid leave, was paying bills and apt rent.
Went on personal visit on jan 2012 (88 days)
Dad was not well and so had to go there as I am the only son and my presence was required
I have pay slips ( but through my limited compnay to show that I have been drawing salary)
Went paid vacation in August 2012 (11 days)
Planning to go for marriage in Nov (23 days)
My total days is 261 days outside UK in which only one leave 88 days is for a personal (compassionate) visit. I can still show salary drawn through my limited company.
Could you please advice if I am eligible as per the new rule as none of my leave if >180 days (per year) The 88 days leave I had to take was for my dad;s health. I have got a medical certificate from the doctor which advices that my dad's health (he is 74 now) was not well.
Do I need to give proofs for all holidays ? including Paid vacation etc?
Thank you for taking time to answer this query.

Your case looks fine to me. You don't need any other evidence. You can follow following discussion

Hi Yash,
Thank you for your reply. I did go through the post. very informative. Thanks again.
I am a bit confused after reading your post? Should I say that for my 88 days visit it was a visit to my family due to health reasons (compassionate) or should I just say it is a family visit? (As all these leaves do not go beyond 180 days in one year?
regards,

@shin25,
If your days spent out side the UK were beyond 180 days then you would have needed compassionate circumstances letter, was it a paid holiday?

Hi Spidery,
Thank you for your reply. I did go through the document earlier.
My leaves (in yearly blocks) have never been over 180 days. So do I still have to provide compassionate letter?
Further what sort of document do they require? Can I just put them as family visit as long as I am keeping it below 180 days for every year?

For small trips you can write, holiday/family trip.
You can include your employers letter stating all absences. You can (for longer absence), attach your father's medical records.

Hi Spidery,
Thanks again for taking time to answer.
Do I still need to submit documents (if I am on tier1) for any leaves (family visit or work purposes) if the days outside UK is less than 180 days in any calendar year?

As all your absences are under 90 days period, you don't need to provide evidence as long as they were paid holidays.
I would suggest to include medical records of your Father, for that 88 days absence just to be on the safe side.
Best .

Hi Spidery,
Thanks for that. It does make me feel more confident. I was self employed during the 88 days period and also for my leaves.
I used to take salary during that time. I hope it still qualifies for a paid vacation?
