Finally I have got my ILR yeahhhhhhh..

I have got an appointment for 24 th Jan at croydon which i will cancel please let me know if you need it.

THATS IT.... my absences were more than 249 days and I didnt provide any absence sheet. I kept it very simple. Didnt gave any P60

I would encourage everyone to go and do their application, dont gofor solicitors/ representatives if you all have your paperwork.

section D2 - I said yes

gave my reason that i visit india everyear.

One of the OSIC mentioned to me that I am not eligible and will be refused but he was wrong.

Can you mention the VISA type and Times lines please.

These are my times and My visa is Tier 1, do i need to talk to a soliciter?

HSMP visa Stamp : 20th March 2008
First Entry into UK : 12th May 2008




Moved to Tier 1(General) - 20th March 2010, Granted for 3 yrs till 20th March 2013




Number of days after stamping : 53 days




Holidays Country Backwards if I apply on March 1st Inshallah

All of these are annual leaves and I have always been paid.




Total Days Outside UK - 237

Arrival and Departure dates are 34.

Total Days outside excluding dep and arr - 203

Total Business Travel 12

Total Days Outside UK excluding business trips and dep and Arr - 191




Questions:




1. Do I need to submit any documents for Holidays?




2. My first job was from June 2008 to March 2009 before i went on holiday, then as soon as i came i was back to work and for NHS. Then they hired me Permanently in DEC 2009, Worked for them till June 2011. Then I moved to another company and I have been working for it so far. Alhamdullila




(A) Do I need to produce any employer letter or all pay slips?

(B) Do I just need to produce pay slips for last 12 months with bank statements?

(C) Do I need p60 for all the 4-5 years.




3. What do I mention in the question

Few questions which might help people who have absences of more than 180 days during the 5-year period and also 90+ days single absence.

Under what VISA category have you applied for ILR ?
Did the case worker ask any questions on absences ?
Were you paid in UK during your absences ?
Did any of your single absence exceed 90 days ?

can you please confirm did you mention your absence in the set o form as you did not provide the separate absesce sheet.

hello

I was on hsmp (25/01/2008) and was granted tier 1 on 26/02/2010.

applied for ILR on 09/01/2012

I did mention my absences in Section 6 and also Under section 9- Q d2- I ticked yes- and wrote a reason. I just Wrote a paragraph saying that my family is in india so I visit them every year.

I didnt gave any separate absences sheet.

Also Regarding Docs like I said Before I kept it very simple i.e. I only gave what was needed according to the form Set 0

My appointment was at 1:30PM - I reached at 1pm, went through security and then paid the fees(15 mins). After that they registered my case which took almost 25 Mins. After that went for biometrics which took 5 mins.

Around 2:15pm the IT system went down and was not working until 3pm. Around 3:45pm, I went to the caseworker and gave all the supporting documents. He was very friendly. He advised to wait for an hour and after 45 min he called me and said your ILR is approved.

Overall experience was OK. What I have seen today is that if you have all the relevant paperwork then it's all OK.

No i didnt had any single absences for more than 90 days ,the case worker didnt ask anything.

He requested P60 but I said I dont have any

As per UKBA Guideline below, how soon I am qualifying for ILR. What is the earliest date?

The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period, as long as it does not exceed 90 days. This can occur if the applicant is delayed travelling to the UK. Provided the period of delay does not exceed 90 days, it will not be counted as an absence. (Link below)

according to my opinion you can still apply 28 days before the visa expiry date via PEO service or by post.

28 Days before 30th of March 2013

Peeru11, you will be eligible to apply from upto 28 days before the 5th anniversary from your EC date. I.e. upto 28 days before 19th March 2013.

Did you say to caseworker that you have P60s at home and just did not bring it along? Just trying to understand how exactly you explained the same.

P60s are not needed as per SET 0. I have P60 for 4 yrs and missing for one. I was not planning on giving P60s to caseworker. In case he/she asks, want to have a clear explanation/statement.

Did he comment anything when you said you dont have P60s with you.
