Help: Applying ILR on next month - IMP questions

Hello All,

I am going to apply ILR next month so i have couple of questions

1) My Situation : HSMP 2 yrs + Tier1 (General) 3 yrs
EC stamp : 04/Mar/2008
Enter to UK : 26 /May/2008 (72 days later)
Tier1(General) Valid til : 11/ Mar/2013
Absences -4 trips - 110 days

i am going to apply ILR on FEB19th so am i eligible to apply ILR on this date.?

2) My wife dependent visa started on 15/03/2011 - valid until 11/03/2013 (same as my visa)

first landed on uk on - 20 - mar - 2011

Is my wife eligible for ILR since she is going to complete 2 years by 20 - MAR- 2013.?


3)Is P60's required for all the 5 years because i do have only 1 P60 and all the remaning P45's for all remaning years. (ofcourse i have asked HMRC to send a letter for my tax payments from 2008 to till now)

Yes

No

P60s are not required HSMP/Tier1 migrants

The best window for you to apply with your wife included as your dependent is between Feb 20 and until your own visa expiration.

I am going to apply on 21st feb since yesterday i have got an appointment at Birmingham.

Hi vgadde,

My understanding is that the ILR qualifiying period starts from the date you enter UK ( in case the qualifying visa was granted outside uk). For your post, i can see that you first entered UK on 26th May 2008. You can apply for ILR 28 days before completing 5 years. ( ie after 2nd May 2013)

I must admit I am not an expert. Please read the FAQ section once and validate with Seniors members

Rule says, if his entry to the UK was within 90 days of Entry Clearance starting date then 5 years start from EC start date. If the entry to the UK was delayed by more than 90 days then 5 years qualifying period start from the date of entry to the UK

Please advise on getting an appointment with 2 dependents in Birmingham.Thanks
